1. Introduction

1.1 The website is owned and operated by Blicken Synths Ltd. Blicken Synths Ltd is a company registered in the UK (Company Reg No 11514199) and is VAT registered (VAT Reg No 305129829). The Terms and Conditions outlined here apply to all users of the website (henceforth referred to a ‘you’) and are always upheld by Blicken Synths Ltd.

1.2 By using our website you agree to the Terms and Conditions set out in this document. You will be asked to give your express agreement to these Terms and Conditions before you will be able to place an order. Blicken Synths Ltd reserves the right to amend these Terms and Conditions at any time without warning. This document will always hold the latest Terms and Conditions.

1.3 This document does not affect any statutory rights you may have as a consumer, including the Sale of Goods Act 1979 and the Consumer Contracts (Information, Cancellation and Additional Charges) Regulations 2013.

2. Purchase of Goods

2.1 The listing of products on our website constitutes an ‘invitation to treat’ rather than a contractual offer.

2.2 All orders made by you through www.blickensynths.co.uk are subject to acceptance by Blicken Synths Ltd. If we refuse your order, we cannot be held liable by any party.

2.3 No contract will come into force between you and Blicken Synths Ltd unless your order is accepted by Blicken Synths Ltd and is in accordance with these Terms and Conditions. You will enter into a contract with Blicken Synths Ltd at the point of dispatch of your goods, unless we have notified you otherwise or you have cancelled your order in accordance with the Terms and Conditions set out in Section 7 – Cancellation. If Blicken Synths Ltd do not accept your order, a full refund will be processed.

2.4 Blicken Synths Ltd may refuse your order for reasons such as Blicken Synths Ltd are unable to obtain authorisation from your bank or suspect fraud, if there have been errors or sales issues with the description of the goods (Section 3) or if the goods are no longer available.

2.5 All special orders for goods that Blicken Synths Ltd do not hold in stock must be paid for in full before commencement of the ordering process.

3. Products

3.1 The products available from Blicken Synths Ltd are Synthesizer Modules and Synthesizer accessories.

3.2 Blicken Synths Ltd regularly review our prices, descriptions and shipping charges and we endeavour to ensure that all the information on www.blickensynths.co.uk is always correct. In the event of discovering an error on the website Blicken Synths Ltd will notify you of this error immediately if it being discovered. If a price is incorrect at the time of placing an order Blicken Synths Ltd will notify you of the price change and offer you a full refund if you no longer wish to purchase the product at the corrected price. Blicken Synths Ltd is under no legal obligation to honour an incorrect price.

3.3 All product images on our website are for illustrative purposes only. Blicken Synths Ltd cannot be held responsible for any differences in the actual product and the images provided by the manufacturer.

4. Prices

4.1 Blicken Synths Ltd prices are quoted on the website in Pound Sterling (GBP)

4.2 Blicken Synths Ltd reserve the right to change the prices on the website at anytime however this will not affect previously completed contracts

4.3 All prices stated in the Terms and Conditions and listed on the website are inclusive of VAT

4.4 Prices are verified through the sales process so that in the instance that prices are incorrectly quoted on the website you will be notified before the contract comes in effect.

4.5 In addition to the price of the products you may be charged delivery fees. These are highlighted in Section 6. You will be notified of these prices before the contract comes into effect.

5. Payments

5.1 During the process of completing your order you must pay the full price, including any potential delivery fees of that order

5.2 Payments can be made using any of the permitted methods on the Blicken Synths Ltd website

5.3 If the full payment is not received by Blicken Synths Ltd under the Terms and Conditions of the agreement then Blicken Synths Ltd may withhold the products ordered by you and / or cancel the order entirely. In such instances you will be informed by e-mail.

5.4 All payments are encrypted and handled securely by Stripe or Paypal. Blicken Synths Ltd do not see your card details at any time.

6. Delivery

6.1 If you order an item that is in stock before 12pm on any business day (Monday to Friday) Blicken Synths Ltd will endeavour to ship your order on the same day, meaning you should receive your order within 24 hours for UK postcodes. This excludes Weekends, Public Holidays and Bank Holidays. Orders placed after 12pm will be shipped on the next business day. Blicken Synths Ltd reserve the right to amend delivery estimates at any point in the order process. If a change does occur, you will be notified by e-mail. In cases of orders of excessive sizes, weights or values may take longer than the estimated time. Blicken Synths Ltd cannot be held responsible for delays in delivery times.

6.2 In the event of an issue with your order such as errors in stock levels or clerical errors, you will be notified by e-mail of a new delivery date or you will be provided with the option of an alternative delivery date. Blicken Synths Ltd will not be liable for any deliveries made outside of the specified delivery estimates.

6.3 UK deliveries will be dispatched using our couriers using their next day delivery service. International deliveries will be dispatched using our international couriers.

6.4 The delivery costs will be automatically calculated based on your shopping basket and location and will be added to the cost of your order (if applicable).

6.5 All deliveries are trackable. You will receive a tracking number when the order has been dispatched.

6.6 All deliveries must be received in person at the delivery address and a signature must be provided.

6.7 At the point of delivery all goods become the responsibility of the customer. From this point onwards Blicken Synths Ltd are not long responsible for any damage or fault arising from incorrect storage or use of the products. The validity and conditions of any refund / return will be affected by any damage considered to be caused by through misuse or neglect.

7. Cancellation

7.1 Under the conditions outlined in the Distance Selling Regulations and in Section 7.2, Blicken Synths Ltd operates a 7 day cooling-off returns policy for products that are still in their original condition (as per Section 7.4). This allows UK and EU customers to cancel their order up to 7 days after receiving their goods. If you wish to cancel your order within the 7 day period please notify Blicken Synths Ltd in writing by letter or by e-mail to info@blickensynths.co.uk. Communicating this wish by telephone is not adequate without prior express written approval from Blicken Synths Ltd. If you cancel your order in accordance with Section 6 you will receive a full refund from Blicken Synths Ltd including delivery costs.

7.2 The right to return goods, as mentioned in Section 7.1, does NOT apply to special orders. Any products which have been specifically ordered on your request or customised to your explicit specifications. This includes any items that are not normally stocked by Blicken Synths Ltd, instead ordered at request of the customer.

7.3 If you wish to exercise your right to cancel this contract within the 7 day cooling-off period then you should return the goods to us, in their original state and within 14 days of receipt. Reasonable care should be taken in returning goods as per the The Consumer Protection (Distance Selling) Regulations 2000 (SI 2000 No.2334). The risk and cost of returning goods to Blicken Synths Ltd shall be accepted by you unless the goods have arrived faulty or damaged (as per Section 8.1) and this has been verified by Blicken Synths Ltd

7.4 If the value of the products returned by you has diminished by any amount Blicken Synths Ltd will be unable to offer a refund. An example of this is damage to the faceplate by screws, unprotected by plastic washers.

7.5 Money will be refunded using the same method used to make payment.

8. Returns

8.1 Blicken Synths Ltd will only accept returns on goods that are received faulty. You have 14 days from receiving your goods in which to notify Blicken Synths Ltd that your goods are faulty. If Blicken Synths Ltd have a replacement in stock then you have 14 days in which to return the goods to Blicken Synths Ltd and, once the fault is verified by Blicken Synths Ltd, a replacement will be dispatched to you. If we do not have a replacement in stock then you are required to contact the manufacturer to seek a replacement. If the product is no longer available from the manufacturer then Blicken Synths Ltd will offer a full refund once the product has been returned to Blicken Synths Ltd and the fault has been verified.

9. Warranty

9.1 All new stock items come with a full 12 month warranty period.

9.2 Some suppliers may offer extended warranty periods. Please check their sites to see if extended warranties are available.

10. Site Usage

10.1 Blicken Synths Ltd make every effort to ensure our website is running 24 hours a day, however if the website is down for maintenance, system failure or issues beyond our control, Blicken Synths Ltd will not be liable if our website is unavailable at any time.

10.2 Blicken Synths Ltd may link to third party websites to provide additional information on our products, for example, youtube videos, images or links. If you choose to view these third- party links, Blicken Synths Ltd does not accept any liability for the suitability or incorrect use of this content. If you choose to view the third-party content, you do so at your own risk.

10.3 Using price scanning tools (automatic or manual) on this website is forbidden without the prior consent of Blicken Synths Ltd. If unauthorised scanning is discovered without prior consent, you agree to fines of up to £1000 a day.

11. Copyright

11.1 Extracts from the website may be used, printed or downloaded for personal use only. Unless stated otherwise, the copyright and other intellectual property rights on all material (including without limitation graphical images, web designs and photographs) are owned by Blicken Synths Ltd or the licensors.

11.2 All product descriptions or images that have been created by Blicken Synths Ltd remain the property of Blicken Synths Ltd and cannot be copied without any prior written consent from Blicken Synths Ltd

12. Liability

12.1 Blicken Synths Ltd, our owners, directors, employees or shareholders will not be liable for any damage or losses that you suffer under the contract which were not a foreseeable consequence of breach of the contract. Indirect losses that were not considered at the time of the contract, including but not limited to, any lose of profits or income, loss of data, business, opportunity or goodwill is not the responsibility of Blicken Synths Ltd.

12.2 Blicken Synths Ltd are not liable for any losses that arise in connection with the website in any way or in connection with the use or inability to use the Blicken Synths Ltd website or any third-party websites that are linked within. This includes, but is not limited to, loss or damage due to viruses that may infect your computer, software, data or other property on account of your use of the website or by downloading any data from the website or third- party websites linked from the website.
